Terms of Service

Acceptance
By creating an account or using Quietly (“the Service”), you agree to these Terms. If you are using the Service on behalf of a funeral home, you represent that you have authority to bind that organization.
Your responsibilities
You are responsible for the content of the messages you send and for obtaining proper consent from every contact you message. Do not use the Service to send unlawful, harassing, fraudulent, or harmful content. Do not text contacts who have opted out.
You must comply with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and the CTIA Messaging Principles and Best Practices. STOP and HELP keywords must remain functional — the Service enforces this automatically.
Billing
Paid plans are billed monthly or annually through Stripe at the rates posted on our pricing page. Included segment and contact quotas are described there. Overages, if any, are metered and billed at the rate disclosed in-app before you incur them. Annual plans are non-refundable after 30 days.
Trial
New accounts receive a 14-day free trial with limited send and contact quotas. We will not charge you during or at the end of the trial — you must affirmatively pick a plan to continue sending.
Cancellation
You may cancel at any time from your billing settings. On cancellation, sending is paused immediately. Your data is retained for 30 days so you can reactivate or export it, after which it is deleted in accordance with our Privacy Policy.
Availability
We aim for high availability but do not guarantee uninterrupted service. We rely on third-party providers (Telnyx, Supabase, Stripe, Vercel) whose availability is outside our direct control.
Limitation of liability
To the maximum extent permitted by law, Quietly’s total liability for any claim arising out of or relating to the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Changes
We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect.
